Developer Terms of Service

1. Agreement to Terms

These terms govern your access to and use of the Configure API, SDKs, and related developer services ("Developer Services") provided by Configure AI, Inc. ("Configure", "we", "us").

By creating an API key, using the SDK, or accessing the Configure API, you agree to these terms. If you are using the Developer Services on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

These terms are in addition to the Configure Privacy Policy.

2. Developer Services

Configure provides APIs, SDKs (TypeScript and Python), and an MCP server that enable you to build AI agents with persistent user profiles. The Developer Services include:

Your API key authenticates your agent and identifies your application. User tokens (JWTs) identify and authorize access to individual user profiles.

5. Conversation Processing

When you send conversations to Configure via the SDK (e.g., for memory extraction or streaming chat), Configure processes these conversations using AI models. Configure may extract and store facts, preferences, and context from these conversations in the user's profile.

You consent to this processing when you use the SDK's memory extraction or streaming features. You are responsible for informing your users that conversations may be processed for memory extraction.

7. Intellectual Property

The Configure SDKs are licensed under the MIT License. The Configure API, platform, brand, and documentation are proprietary to Configure AI, Inc.

You may not use the Configure name, logo, or brand in a way that implies endorsement without prior written permission. You retain ownership of your application code that integrates with Configure.

Either party may terminate this agreement at any time. Configure may immediately suspend or revoke your API access if you violate these terms.

Upon termination, you must cease using the Developer Services and delete any cached user data. User data processed through your application remains the property of the user and continues to be managed by Configure.

Termination does not affect user profiles. Users retain their data independently of your application.

10. Indemnification

You agree to indemnify and hold Configure harmless from any claims, damages, or expenses arising from your use of the Developer Services, your application, or your violation of these terms. This includes any claims by your end users or third parties related to your handling of profile data.

11. Disclaimers

The Developer Services are provided "as is" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Configure does not warrant that the API will be uninterrupted, error-free, or secure. Configure is not responsible for the accuracy of AI-extracted data or profile content.

12. Limitation of Liability

To the maximum extent permitted by law, Configure shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Developer Services.

Configure's total liability shall not exceed the fees paid by you to Configure in the 12 months preceding the claim, or $100, whichever is greater.

13. Modifications

We may modify these terms at any time. We will provide at least 30 days' notice of material changes via email or the developer dashboard. Continued use of the Developer Services after changes take effect constitutes acceptance of the modified terms.

14. Governing Law

These terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
